I would just like to add that it is often advisable to run the applicable
regulations past your counsel. Regulations may not always mean what they
seem to say and the applicability of a particular regulation may be
defined in another section of the regulation.
Take the Minnesota regulation that I previously sent out to the list. This
regulation requires a current + 8 year retention for records which
contain various information including "the date of separation & the
reason, in detail, for the termination;"
Where would you find a detailed description of the date and detailed
reason for termination? Is this applicable to personnel files? Or in
Minnesota do you merely need to reference reason for termination in your
payroll records?
By the way if there is anyone from Minnesota who could tell me the
reasoning behind this 8 year requirement I would be really interested.
