" the two Rambus rulings are “very significant” in setting a straightforward
standard for when companies should preserve evidence in a reasonable
anticipation of litigation. “This was an extreme example, where the
shredding was measured in tons,” he said. “But there are a lot of district
court cases out there where people are citing Whyte saying it takes a lot to
be a spoliator.” These rulings, he said, will put an end to that argument. "
