Under "Public Domain Content", I recommend cutting the second half of the compound sentence:
"For retrospective digitization, if the source materials are in the public domain, copyright cannot be claimed in the digital reproductions, and no restrictions on use are enforceable."

Or, changing the second half to be: "no restrictions on use based on copyright are enforceable." Materials may be in the public domain per copyright laws for published materials, but that doesn't mean that other rules don't also apply (donor agreements, partnership agreements, moral rights with cultural heritage documents, FERPA for faculty papers). Even rules for archival versus published materials could be confusing, so removing the clause on "no restrictions" seems like the simplest solution. 

Also, under "Materials under Copyright," I recommend removing the negative clause ("which in general, the rights holder will not do") so that this sentence:
"Copyright remains with the original rights holder unless it is assigned or otherwise transferred to the individual University, which in general, the rights holder will not do." 

Becomes: "Copyright remains with the original rights holder unless it is assigned or otherwise transferred to the individual University."

Given the variety of projects in the state and given the success many projects have already had (retrospective dissertation scanning, oral histories, newspapers), I think the sentence makes more sense without the final clause.

I have an issue for both DISC and the CAGER Revision Group, but I think 
it has to go to DISC first.

As part of moving to Drupal, all FCLA Web pages are being reviewed & 
revised.  I am moving the PALMM documentation to Drupal and updating 
them as I go along.  I have a revised draft of the Copyright Guidelines 
page that recommends both what to do and how to do it (in MARC and 
Dublin Core).  I think DISC should take a look at the "what to do" 
first, and then if you all agree we can pass it along to the CAGER 
Revision Group to vet the encoding suggestions and include them in their 
own Guidelines.

I put a copy of the draft revised page on the DISC wiki at 
http://swiki.fcla.edu:8000/DISC/20. Comments by email are welcome.  If 
necessary we can see about adding this to our next agenda as well.
