Case Law and Statutes Changing the Shape of Social Media Discovery
t is important to remember that, while users create social media content,
the electronically stored information itself resides on the servers of the
social media provider. This means that, both regarding Fourth Amendment
search-and-seizure jurisprudence and civil property rights, users have no
right of privacy in the data stored on the media of the providers other
than what the provider may guarantee the user in terms of service or other
usage agreement, as in Smith v. Maryland, 442 U.S. 735 (1979), which held
that there is no right of privacy in pen register information, and United
States v. Miller, 425 U.S. 435 (1976), which held that there is no right of
privacy in bank records.
